The reform to the Political Constitution of the United Mexican States of May 15, 2019 modified, among others, article 3 to include the right to enjoy the benefits of the development of science and technological innovation. Article 26 establishes that the State will organize a democratic planning system for national development that provides solidity, dynamism, competitiveness, permanence, and equity to the growth of the economy for the independence and political, social, and cultural democratization of the nation.
Likewise, in section XXIX-F of article 73, it reaffirms the commitment of the Mexican State to support humanist, scientific and technological research and endows the Congress of the Union with powers to issue legislation on the matter with general bases for coordination between the federal government, the governments of the federal entities and the governments of the municipalities and territorial demarcations of Mexico City, in order to consolidate the National System of Science, Technology and Innovation.
The Planning Law, in its articles 2, 4, 12 and 14, regulates planning on equitable, inclusive, comprehensive, sustainable and sustainable development of the country, its methodology and those responsible; In addition, Article 17, Section II establishes that parastatal entities must prepare their respective institutional programs, taking into account the provisions contained in the corresponding sectoral program, observing the respective environmental, economic, social and cultural variables as appropriate.
For its part, the National Council of Science and Technology (Conacyt), which is by mandate of Law the advisory and specialized entity to articulate the public policies of the Federal Government and promote scientific and technological research, development and technological modernization of the country, as well as innovation, it has in its hands the task of coordinating the materialization of the constitutional reform. The foregoing translates into directing scientific and technological capacities to address and solve priority national problems and, in general, contribute to the welfare state, promoting optimal conditions that allow science to develop efficiently and without simulations.
By its nature, INFOTEC is a Public Trust of the Federal Government established by contract number 061-1 dated December 30, 1974, by the National Council of Science and Technology, as Settlor and Nacional Financiera, S.N.C., as Trustee, and recognized as a Public Research Center (CPI) in terms of the Agreement of the Ministry of Public Education and the National Council of Science and Technology published in the DOF on August 16, 2000, sectorized to the latter, and recognized as this character in accordance with the Articles 47 and 48 of the Science and Technology Law, with various amending agreements dated October 21, 1994, September 5, 1997, November 10, 2000, January 18, 2007, May 29, 2009, December 6, 2011, June 12, 2014, and the most recent signed on November 18, 2022.
INFOTEC is considered a Parastatal Public Administration Entity in accordance with the provisions of articles 90 of the Political Constitution of the United Mexican States, 1, 3, section III, 9 and 47 of the Organic Law of the Federal Public Administration , and 1° and 40° of the Federal Law of Parastatal Entities.
